Terms of Service

These Terms of Service (the "Terms") set out the conditions for using the mobile app "Kakegoe" (the "App") provided by Do. LLC ("we", "us"). Anyone who uses the App (a "user") is deemed to have agreed to these Terms.

1. Scope

1. These Terms govern the provision of the App and the rights and obligations between the user and us, and apply to every use of the App.
2. Any separate rules or guidelines we set out within the App form part of these Terms. Where they conflict with these Terms, the separate rules prevail unless stated otherwise.

2. Operating environment

1. The communication equipment, data charges and electricity needed to use the App are the user's responsibility.
2. Users are responsible for checking that their environment (supported OS versions and so on) meets the App's requirements.

3. Accounts

The App requires no account registration. Presets, training records and settings are all stored on the user's own device.

4. Prohibited conduct

When using the App, users must not:

1. Violate laws or public order and morals
2. Infringe the intellectual property, privacy, reputation or other rights and interests of us, other users or third parties
3. Exploit vulnerabilities in the App, or reverse-engineer, decompile or disassemble it
4. Improperly copy, modify or redistribute the App's source code, assets or data structures
5. Fraudulently click the ads served in the App (Google AdMob) or interfere with ad delivery
6. Obtain or extend the Pro entitlement, or a temporary unlock of a sound or theme, by improper means
7. Operate the App with automated tools such as bots
8. Do anything else we judge to be inappropriate

5. Advertising

1. The App shows no banner ads and no interstitial ads. The only ad format is rewarded video.
2. A rewarded video plays only when the user opens the Pro sheet from a locked sound or theme and chooses to watch it. Watching unlocks that one sound or theme for 24 hours.
3. No purchase or ad prompt is shown on the running screen during a workout.
4. Watching is optional; every free feature remains available without it.
5. Advertisers, ad content and ad delivery are controlled by Google. We are not responsible for problems arising from the content of an ad.

6. Pro / purchases

1. The App is free to use, and the additional features are offered as a single one-time purchase, "Pro". It is not a subscription.
2. Pro includes step editing (building a preset row by row so that each round can have its own length), the sound packs (Whistle / Hyoshigi), the themes (Amber / Purple / Orange / Lime) and preset export / import. We will announce any change to what it contains in advance.
3. The spoken cues (Japanese / English) are not a paid feature. The voice that reads them belongs to the device's OS, so we cannot choose or supply a speaker. The cues are therefore free from the start.
4. We will never move something that is free behind a paywall later. Presets you saved for free stay usable, however many you saved. Presets built with step editing also stay visible and playable if Pro is no longer available, and are never deleted (editing their steps needs Pro).
5. Prices and currencies follow the App Store / Google Play listing. Purchases and refunds are handled under each store's terms. We do not receive payment details.
6. A purchase can be carried over to another device with "Restore purchases" under the same store account.

7. Your data

1. Everything the App creates (presets, training records, settings) is stored on the user's device.
2. Users can take their data out as a JSON file with the Pro export / import feature. Managing the exported file is the user's responsibility.

8. Intellectual property

1. All copyright, trademarks and other intellectual property in the App belong to us or to the third parties who hold them.
2. Users may use the App privately within the scope of these Terms. Redistribution, reproduction and modification are prohibited.
3. The typefaces used by the App (Tilt Neon / Sora / Zen Kaku Gothic New) are used under the SIL Open Font License. The licence notice is included in the App.

9. Disclaimer

1. We do not warrant the accuracy, completeness, usefulness or fitness for a particular purpose of the App's contents.
2. The App is provided "AS IS" and is used at the user's own risk.
3. The App is not a medical device and is not intended to diagnose, treat or prevent any condition. Nor does it instruct or recommend any training programme. It is a timer that counts the seconds you yourself set. The intensity, the exercises and whether to train at all are your own decisions; consult a doctor or another professional where appropriate.
4. We are not responsible for injury, illness or other harm to health arising during exercise. Stop immediately if you feel unwell.
5. The App is not an alarm and does not guarantee that a moment in time will be announced. OS power-saving settings, other apps and the state of the device can delay or suppress the sound, the vibration and the notification. Do not rely on the App alone for timekeeping.
6. Long or loud playback may affect your hearing. Please set the volume sensibly.
7. We accept no liability for damage arising from the use of the App (loss or corruption of device data, lost opportunities, financial loss and so on), except where caused by our wilful misconduct or gross negligence.

10. Changes to and discontinuation of the App

1. We may change the App's contents or features, or stop providing it, without prior notice to users.
2. We are not liable for damage to users or third parties arising from such a change or discontinuation.

11. Changes to these Terms

1. We may revise these Terms without prior notice where we judge it necessary.
2. Revised Terms take effect when they are published on this page.
3. Using the App after a revision is deemed acceptance of the revised Terms.

12. Governing law and jurisdiction

1. These Terms and the use of the App are governed by the laws of Japan.
2. The Tokyo District Court has exclusive jurisdiction as the court of first instance over any dispute arising out of or relating to the App.
