Terms of Use

These Terms of Use (the “Terms”) govern your use of the mobile app “yoruoto” (the “App”) provided by Do. LLC (“we”). By using the App you are deemed to have agreed to these Terms.

1. Scope

  1. These Terms set out the conditions on which the App is provided and the rights and obligations between you and us, and apply to all use of the App.
  2. Any separate rules or guidelines we publish in the App form part of these Terms. Where they conflict with these Terms, the separate rules prevail unless stated otherwise.

2. Your environment

  1. The devices, data charges and electricity needed to use the App are your responsibility.
  2. You are responsible for checking that your device meets the App’s requirements (supported OS versions and so on).

3. Accounts

The App requires no account. Your mixes and settings are stored on your device.

4. Prohibited conduct

You must not:

  1. Act unlawfully or contrary to public order and morals
  2. Infringe the intellectual property, privacy, reputation or other rights of us, other users or third parties
  3. Exploit vulnerabilities in the App, or reverse engineer, decompile or disassemble it
  4. Copy, modify or redistribute the App’s source code, assets or data structures without authorisation
  5. Click the ads served in the App (Google AdMob) fraudulently, or interfere with ad delivery
  6. Obtain or extend the Pro entitlement or a temporary sound unlock by improper means
  7. Operate the App with automated tools such as bots
  8. Do anything else we reasonably consider inappropriate

5. Advertising

  1. The App shows no banner or interstitial ads. The only ads are reward videos.
  2. A reward video plays only when you open the Pro sheet from a locked sound and choose to watch it. Watching unlocks that sound for 24 hours.
  3. Watching is entirely optional; every free feature works without it.
  4. Advertisers, ad content and ad delivery are controlled by Google. We are not responsible for problems arising from ad content.

6. Pro and payment

  1. The App is free to use. The extras are offered as a single one-time purchase called “Pro”. It is not a subscription.
  2. Pro includes the additional sounds (12 in total), the “Indigo” and “Paper” themes, and exporting / importing mixes. We will give notice before changing what it includes.
  3. What is free today will not become paid later. Mixes you saved for free remain usable, however many you saved.
  4. Prices and currencies follow the App Store / Google Play listing. Purchases and refunds are governed by those stores’ terms. We never receive your payment details.
  5. A purchase can be carried over to another device with “Restore purchases” using the same store account.

7. Your data

  1. Everything the App creates (mixes, settings, last timer settings and so on) is stored on your device.
  2. With the Pro export / import feature you can take your data out as a JSON file. Looking after that file is your responsibility.
  3. See the privacy policy for details of how data is handled.

8. Intellectual property

  1. All copyright, trade marks and other intellectual property in the App belong to us or to the third parties who hold them.
  2. You may use the App privately within the scope of these Terms. Redistribution, republication and modification are not permitted.
  3. The typefaces used by the App (Shippori Mincho / Zen Kaku Gothic New) are used under the SIL Open Font License. The licence texts are included in the App.

9. Disclaimer

  1. We do not warrant that the App is accurate, complete, useful or fit for any particular purpose.
  2. The App is provided “AS IS” and you use it at your own risk.
  3. The App is not a medical device and is not intended to diagnose, treat or prevent sleep disorders or any other condition. If you have concerns about your sleep, please consult a doctor or another qualified professional.
  4. The App is not an alarm clock and does not guarantee that you will wake up. Power-saving settings, other apps or the state of your device may prevent playback or the timer notification. Please do not rely on it to wake you or to keep time.
  5. Listening loudly for long periods may affect your hearing. Please keep the volume at a comfortable level.
  6. We are not liable for any loss arising from your use of the App (loss or corruption of data on your device, lost opportunities, financial loss and so on), except where caused by our wilful misconduct or gross negligence.

10. Changes and discontinuation

  1. We may change the App’s content or features, or stop providing it, without prior notice.
  2. We are not liable for loss suffered by you or any third party as a result.

11. Changes to these Terms

  1. We may revise these Terms without prior notice where we consider it necessary.
  2. Revised Terms take effect when published on this page.
  3. If you use the App after a revision, you are deemed to have agreed to the revised Terms.

12. Governing law and jurisdiction

  1. These Terms and your use of the App are governed by the laws of Japan.
  2. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any dispute arising out of or relating to the App.
