These Terms of Service (the "Terms") set forth the conditions of use of the mobile application "Ehon Plus" (the "Service") provided by Do. LLC (the "Operator"). Anyone who uses the Service (the "User") shall do so in agreement with these Terms.

Article 1 (Application)

  1. These Terms are intended to define the conditions for the provision of the Service and the rights and obligations between the Operator and the User, and shall apply to any and all relationships between the User and the Operator concerning the use of the Service.
  2. Rules, notices, guidelines, and similar materials posted from time to time on the Service ("Individual Provisions") shall form part of these Terms.
  3. If the provisions of these Terms conflict with those of an Individual Provision, the Individual Provision shall prevail unless otherwise specifically provided.

Article 2 (Definitions)

The terms used in these Terms are defined as follows:

  1. "User" means any individual who uses the Service.
  2. "Content" means picture books, text, images, audio, video, and any other information provided by the Operator on the Service.
  3. "Device" means a smartphone, tablet, or other electronic device used by the User to access the Service.

Article 3 (Registration)

  1. The Service does not require account registration. The User is deemed to have agreed to these Terms upon downloading, installing, and launching the Service.
  2. If account-registration features are introduced in a future update, the Operator will update these Terms accordingly and notify Users.

Article 4 (Fees)

  1. The Service is currently provided free of charge.
  2. Communication costs (mobile data charges, Wi-Fi access fees, etc.) and the cost of preparing the Device required to use the Service shall be borne by the User.
  3. If paid features (such as subscriptions) are introduced in a future update, the Operator will notify Users in advance and will charge fees only after obtaining explicit consent.

Article 5 (Content Rights and Grant of License)

  1. Copyright, trademark rights, and other intellectual property rights in the picture books, text, images, audio, UI elements, and any other Content provided through the Service belong to the Operator or to the rightful rights holders.
  2. The User is granted only the right to view such Content for non-commercial, private use through the Service.
  3. Without the Operator's prior written permission, the User shall not use the Content, in whole or in part, in any of the following ways:
    • Reproduction, reprinting, transfer, lending, distribution, public transmission, or the creation of derivative works
    • Use for commercial purposes (including for-profit storytelling sessions, paid distribution, or posting on social media)
    • Modification, adaptation, summarizing, or analysis
  4. For collective use by educational institutions, childcare facilities, and the like, please contact the Operator separately.

Article 6 (Prohibited Acts)

The User shall not engage in any of the following acts when using the Service:

  1. Acts that violate laws or public order and morality
  2. Acts related to criminal activity
  3. Use of the contents of the Service or Content beyond the scope of the license granted under these Terms
  4. Acts that destroy or interfere with the functions of the servers or networks of the Operator, other Users of the Service, or third parties
  5. Acts that may interfere with the operation of the Operator's services
  6. Unauthorized access, or attempts thereof
  7. Analyzing the internal structure or program of the Service (except as permitted by applicable law)
  8. Acts that infringe upon the rights of other Users or third parties
  9. Mass-accessing the Service by automated means (bots, scraping, etc.) in connection with the Service
  10. Any other acts that the Operator deems inappropriate

Article 7 (Suspension, Change, etc., of the Service)

  1. The Operator may, without prior notice to the User, suspend or interrupt the provision of all or part of the Service if any of the following applies:
    1. When performing maintenance, inspection, or updates of the computer systems supporting the Service
    2. When provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters
    3. When computers or communication lines are halted due to an incident
    4. Other cases where the Operator deems the provision of the Service to be difficult
  2. The Operator may change, add to, or discontinue all or part of the contents of the Service without prior notice to the User.
  3. The Operator shall not be liable for any disadvantage or damage suffered by the User or any third party arising from the suspension, interruption, or change of the Service, except as otherwise provided in these Terms.

Article 8 (Force Updates and Maintenance Mode)

  1. When the Operator deems it necessary for safety, compatibility, or quality maintenance of the Service, it may require Users to update to the latest version of the Service. In such a case, the Service cannot be used until the update is completed.
  2. The Operator may temporarily suspend Users' access to the Service during maintenance. The Operator shall not be liable for inability to communicate or for feature outages during maintenance.

Article 9 (Advertising and Paid Features)

The Service currently does not display any advertising and does not offer any paid features. If advertising or paid features are introduced in the future, the Operator will revise these Terms and notify Users.

Article 10 (Handling of Personal Information)

The Operator's handling of the User's personal information shall be governed by the separately established Privacy Policy. By using the Service, the User is deemed to have agreed to the Privacy Policy.

Article 11 (Disclaimer of Warranties and Limitation of Liability)

  1. The Operator makes no warranty, express or implied, that the Service is free from defects in fact or in law (including, but not limited to, defects, errors, bugs, or rights infringements relating to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, or security).
  2. The Operator shall not be liable for any damages suffered by the User arising from the Service, except in cases of intentional misconduct or gross negligence on the part of the Operator.
  3. Even if the Operator becomes liable to compensate the User for damages caused by reasons attributable to the Operator, the amount of such damages shall be limited to the total amount paid by the User to the Operator for the Service during the most recent 12-month period. While the Service is provided free of charge, the amount of damages payable under this provision shall be JPY 0.
  4. The Operator shall not be liable for any transactions, communications, or disputes between Users and other Users or third parties in connection with the Service.

Article 12 (Age Restrictions / Parental Responsibility)

  1. The Service is a book-reading application intended for use by children, including preschool-age children.
  2. Minor Users shall use the Service under the responsibility of a parent or guardian. The parent or guardian is deemed to have understood these Terms and consented to the minor's use of the Service.
  3. The Operator expects that any matter arising from a minor's use of the Service will be handled under the responsibility of the parent or guardian.

Article 13 (Changes to Service Content)

The Operator may change the content of the Service or discontinue its provision without notice to the User, and shall not be liable for any damages suffered by the User as a result. However, in the event of a complete termination of the Service, the Operator will make reasonable efforts to provide advance notice.

Article 14 (Changes to the Terms)

  1. The Operator may amend these Terms. For material changes that may affect Users' rights or obligations, the Operator will provide a reasonable advance notice period before the effective date and will publicize the effective date and content of the revised Terms via in-app notification or by posting at the public URL above.
  2. Minor changes such as correcting typographical errors, refining wording, and other changes that do not substantively affect Users' rights or obligations may be made without the notice described in the preceding paragraph.
  3. If a User continues to use the Service after the effective date of the revised Terms, the User is deemed to have agreed to the revised Terms. A User who does not agree to the revised Terms may discontinue use of the Service.

Article 15 (Notices and Communications)

Notices and communications from the Operator to Users shall be made via in-app notification within the Service or by posting at the public URL above. Such notices shall be deemed to have reached the User at the time they are dispatched.

Article 16 (Prohibition of Assignment)

The User shall not, without the Operator's prior written consent, assign or pledge as security its position under these Terms or any rights or obligations arising under these Terms to any third party.

Article 17 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. In the event of a dispute arising in connection with the Service, the court having jurisdiction over the location of the Operator's head office shall have exclusive jurisdiction as the agreed first-instance court.
  3. Notwithstanding paragraph 2, for consumers habitually resident in the EU, nothing in this Article shall limit such consumers' rights to the protection of mandatory provisions of the law of their country of residence (including consumer-protection provisions), or their right to bring proceedings in the courts of their country of residence.
